Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hubcast (“Hubcast”, “we”, “us”), a tool for drafting, approving, scheduling, publishing and measuring content across your connected social channels and email newsletters. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The service

Hubcast lets you and your team draft posts and newsletters, run them through an approval workflow, publish them to social accounts you connect, and view analytics. Features may change, and the service is offered on an ongoing, best-effort basis.

2. Accounts and eligibility

  • You must be at least 18 years old and able to enter into a binding agreement.
  • You are responsible for the accuracy of your account information, for keeping your password secure, and for all activity under your account and workspace.
  • You are responsible for your team members’ use of your workspace and for the roles and permissions you grant them.

3. Acceptable use

You agree not to use Hubcast to:

  • break the law, infringe others’ rights, or publish content that is unlawful, deceptive, harassing, or hateful;
  • send unsolicited bulk email (spam), or email recipients who have not consented or who have unsubscribed;
  • attempt to gain unauthorized access to the service, disrupt it, or circumvent its security, rate limits or usage controls;
  • violate the terms of any connected platform (see section 5).

4. Your content

You retain ownership of the content you create, upload or publish through Hubcast (“Your Content”). You grant us the limited right to store, process and transmit Your Content solely to operate the service and perform the actions you request — for example, to publish a post you have approved or to send a newsletter to a list you manage. You are solely responsible for Your Content and for having the rights necessary to use and publish it.

5. Connected platforms and third-party terms

When you connect a social account (such as LinkedIn or Meta / Facebook / Instagram), Hubcast acts on your instruction, through each platform’s official API and the permissions you grant, to publish content and read analytics. Your use of those platforms remains subject to their own terms and policies, and you are responsible for complying with them. We are not responsible for the availability, behaviour, or policy changes of third-party platforms, or for content once it has been published to them.

6. Email and anti-spam

You are solely responsible for the mailing lists you upload or build in Hubcast, including that every recipient has consented to receive your email and that your use complies with applicable anti-spam and data-protection laws (including the GDPR and marketing-consent rules). Every newsletter includes an unsubscribe link; you must not remove or disable it, and unsubscribed addresses are suppressed.

7. Availability, beta features and changes

We work to keep Hubcast available and reliable but do not guarantee uninterrupted or error-free operation, and some features may be offered as early-access or beta. We may add, change or remove features, and may perform maintenance that temporarily affects availability.

8. Intellectual property

Hubcast, its software, and its branding are owned by us and our licensors and are protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service; they do not transfer any ownership in Hubcast to you.

9. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will meet your requirements or that publishing or analytics from third-party platforms will be accurate, complete or uninterrupted.

10. Limitation of liability

To the fullest extent permitted by law, Hubcast will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using Hubcast and request deletion of your account at any time (see our Privacy Policy). We may suspend or terminate access if you breach these Terms or use the service in a way that risks harm to others or to the service. On termination, your right to use the service ends and we will delete or anonymize your data as described in the Privacy Policy.

12. Governing law

These Terms are governed by the laws of Norway, without regard to its conflict-of-laws rules. The courts of Norway will have jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have where you live.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above; your continued use of the service after a change takes effect constitutes acceptance of the updated Terms.
